Terms and conditions

Cleanwise's terms and conditions for cleaning and post-construction cleaning.

1. Scope

These terms and conditions apply to all quotes, orders and work by Cleanwise, hereinafter “Cleanwise”. By accepting a quote or placing an order, the customer accepts these terms. Deviations only apply if agreed in writing.

2. Quotes

All work is carried out on request. Quotes are free of obligation and valid for 30 days, unless stated otherwise. They are based on the information provided by the customer. If the situation on site turns out to be different, Cleanwise may adjust the price in consultation.

3. Execution

Cleanwise carries out the work itself, with the care of a good professional. This is an obligation of means.

The customer ensures the work site is freely accessible and that water and electricity are available where needed. The customer removes fragile or valuable items near the work area beforehand.

4. Scheduling

Appointments are scheduled in consultation with the customer. If an appointment cannot go ahead due to force majeure, such as illness or an unsafe work site, we reschedule it as soon as possible. This does not give rise to any compensation.

5. Cancelling or rescheduling

The customer may cancel or reschedule an appointment free of charge up to 48 hours in advance. For later cancellations, or if Cleanwise cannot work on site because of the customer, Cleanwise may charge the costs already incurred.

6. Consumer right of withdrawal

If a consumer concludes the contract at a distance or off-premises, they have a 14-day right of withdrawal. If the consumer expressly asks for the work to start within that period, they pay for the part already carried out in case of withdrawal. The right of withdrawal lapses once the work has been fully performed.

7. Prices and payment

Prices are in euros. For consumers they include VAT, unless stated otherwise. Invoices are payable within 14 days of the invoice date, to the account number on the invoice.

In case of late payment, the statutory rules on late payment apply. For consumers, a free reminder with a 14-day deadline is sent first.

8. Complaints

The customer reports complaints about the work in writing, preferably with photos, within 8 days of the work via info@niya-solutions.be. Cleanwise looks into every complaint and seeks a solution together with the customer. A complaint does not suspend payment of the undisputed part. Consumers' statutory warranty rights remain fully applicable.

9. Liability

Cleanwise is not liable for damage caused by defects that existed before the work, such as loose joints or tiles, damaged coatings, worn seals, hidden defects or poorly installed materials. Where such defects are visible, Cleanwise reports them in advance.

Except in case of intent or gross negligence, Cleanwise's liability is limited to the invoiced amount of the work concerned.

10. Privacy

Cleanwise only uses personal data to prepare quotes, carry out work and invoice. Read more in the privacy statement.

11. Applicable law

All contracts are governed by Belgian law. Disputes that cannot be settled amicably are submitted to the competent courts. Consumers may also contact the Consumer Ombudsman Service (consumerombudsman.be).
